Dan Miller Named to LABJ’s 2025 Leaders of Influence: Banking & Finance

The Los Angeles Business Journal has recognized partner Dan Miller for his exceptional work in banking and finance litigation, naming him to its 2025 list of the Leaders of Influence: Banking and Finance.

Dan represents major banking institutions and private equity firms in high-stakes litigation, earning a reputation for resolving complex financial disputes with strategic precision. Highlights include:

  • $20 million recovery for The Gores Group in a federal court case (S.D.N.Y.) and over $11 million won in international arbitration for a global private equity affiliate—both involving high-value financial disputes. Dan also defeated a $30 million counterclaim in the international arbitration.
  • A decisive win for Cathay Bank, securing summary judgment on all claims in a fraud and breach of contract case, along with winning summary judgment on an affirmative claim by the bank for breach of a loan agreement and over $1 million in attorneys’ fees.
  • Representing three multi-billion-dollar private equity firms in a legal malpractice case against a top-tier global law firm involving over $100 million in debt instrument investments, resulting in a favorable confidential settlement.
  • Defending a former CFO of a film finance company targeted in a financial fraud probe. Thanks to Dan’s advocacy, the client faced no charges despite serious allegations stemming from the CEO’s embezzlement.

Dan’s victories in real estate-related finance cases include:

  • Representing the Horn Trust, majority owner of $100+ million in commercial properties, in a complex case involving an $8 million embezzlement claim and buy-sell disputes—securing full management control and a monetary award through strategic use of California Penal Code §496(c) and over five years of hard-fought litigation.
  • Representing ER Group in multiple actions, including a $44 million lawsuit against a collapsed real estate firm, a Big Five auditor, and a consulting company for financial misconduct, followed by New York litigation against a hedge fund to recover $11 million tied to the HHLA project in Los Angeles. Both matters resulted in confidential settlements.

Dan is currently leading several high-impact cases, including:

  • Representing Wave Investments in a $25+ million fraud and breach of non-circumvention agreement lawsuit against SecurCapital. Dan has already defeated dismissal attempts and summary judgment; the trial is set for February 2026.
  • Defending private equity firm GI Partners in elder abuse and fraud litigation over a skilled nursing facility portfolio, leveraging a prior no-cost dismissal in a similar case to build the defense.
  • Representing a prominent family office in a confidential arbitration involving embezzlement and misuse of funds by a former employee, while navigating labor-related counterclaims before Hon. Amy D. Hogue (Ret.) of Signature Resolution.
