Biography

Justin Ehrlich is a tenacious trial lawyer with significant experience representing both plaintiffs and defendants, having obtained multiple seven- and eight-figure verdicts, arbitration awards, and settlements. He specializes in complex business disputes,  professional liability, insurance bad faith, employment, among other areas. His clients have included entrepreneurs, top Los Angeles lawyers, private equity firms, Rock and Roll Hall of Fame member musicians, and technology companies.

Justin grew up in Southern California. He received his Juris Doctor from the University of Southern California and earned a Bachelor’s Degree in History from the University of California at Los Angeles. Prior to Miller Barondess, Justin was a partner with Herzog, Yuhas, Ehrlich & Ardell, where he practiced with renowned trial lawyer Buddy Herzog.

Justin is a former member of the Executive Board of Cancer Free Generation (CFG) and still works to raise funds for clinical research aimed at eradicating cancer.

Notable Representations
  • Co-lead counsel in a ground-breaking financial elder abuse case involving the sale of deferred annuities to senior citizens. The case was the first of its kind to go to trial and resulted in an $18,500,000 jury verdict, the 100th largest verdict in the U.S. in 2006, and the largest verdict on record at the time in the Indio Superior Court. The case was settled with two of the three defendants and then reversed due to a so-called “flaw” in the C.A.C.I.-approved verdict form. This case, tried over eight weeks, remains a model for elder abuse attorneys with similar cases from around the country.
  • Lead trial lawyer in a medical malpractice case against a healthcare provider, where the plaintiff alleged that the client infant was deprived of oxygen during the birth process resulting in permanent brain injury. The healthcare provider claimed the injury was the result of a genetic defect and did not offer a single penny. After a three-week arbitration, the plaintiff was awarded $11,640,000, and the case was later settled for $11,890,000.
  • Represented the rock band Red Hot Chili Peppers in a federal suit involving the use of its famous song and album title “Californication.” This intellectual property case dealt with complex issues because while a title is generally afforded no copyright or trademark protection, one that achieves a secondary meaning is, under limited circumstances, afforded protection. The case was resolved on a confidential basis following denial of defendants’ motion to dismiss.
  • Successfully arbitrated a complex legal malpractice case against a top Los Angeles litigator resulting in an award of over $5,000,000.  Justin later pursued the involved insurance carrier for insurance bad faith and successfully secured a total amount well in excess of the original amount awarded.
  • Lead trial lawyer for a well-known Los Angeles litigator when his former law firm sued him in connection with his departure in 2006 following the indictment of another firm partner. After a five-year battle, the firm received nothing for its claims, but Justin’s client recovered $4,600,000 on cross claims.
  • Represented technology executives against a foreign conglomerate operating throughout the world in an earn-out dispute resulting in a multi-million-dollar confidential resolution.
  • Represented the family of a fallen L.A.P.D. officer in a complex road-design case against the City of Beverly Hills resulting in a $9,000,000 settlement following years of litigation.
