Biography

Zachary Sarnoff is a business litigator with experience advising clients in state and federal courts throughout the country on a variety of complex litigation matters, including intellectual property, contract, antitrust and unfair competition, mergers and acquisitions, fraud, breach of fiduciary duty, product liability, corporate governance, and general commercial.  He has represented clients in class actions and multidistrict litigation.

In 2023, Zach was recognized by his peers in Los Angeles as a “Best Lawyers® One to Watch” for Commercial Litigation.

A San Diego native, Zach received his Bachelor’s degree in Psychology from UCLA.  He received his Juris Doctor from the University of Michigan Law School, where he graduated Order of the Coif.

Prior to joining Miller Barondess, Zach served as a Law Clerk for the Honorable Frank P. Geraci, Jr. in the United States District Court for the Western District of New York and was a litigation associate at Sullivan & Cromwell LLP in Los Angeles.

Notable Representations
  • Represented private equity companies in antitrust multidistrict litigation concerning alleged price-fixing in the packaged tuna industry, in which civil plaintiffs sought over $1 billion in damages.
  • Represented multinational beverage company and its subsidiaries in connection with a variety of active and potential trademark disputes.
  • Represented multinational electronics company and its subsidiaries in connection with contractual and corporate governance disputes arising from mergers and acquisitions in the health care technology space.
  • Represented Class I railroad in regulatory proceedings arising from its $31 billion deal to acquire another Class I railroad.  Following a two-week hearing, the Surface Transportation Board issued a decision approving the merger.
  • Represented foreign investment companies in Delaware litigation arising from investment in an Israeli nanotech company.  Obtained dismissal of all claims with prejudice.
  • Represented private equity company in responding to third-party subpoena arising from patent infringement and breach of contract litigation involving one of its portfolio companies.
  • Represented multinational athletics company in responding to third-party subpoenas arising from FTC antitrust litigation against a prominent technology company.
